Despite recent rumors that Beijing’s plans for a new energy law had been put on hold, the government will unveil its proposal for an energy megaministry at the March 11 legislative session, the South China Morning Post has reported, citing a source close to the plan. Chinese President Hu Jintao could be trying to bypass key legislative barriers to the creation of the powerful energy ministry.

 

The Chinese government will unveil its plan to consolidate the country’s energy agencies into one Cabinet-level “megaministry” at the March 11 legislative session, the South China Morning Post reported March 10, citing an unnamed delegate to the Chinese People’s Political Consultative Conference. The new State Energy Commission, according to the source, will subsume at least 10 government agencies and state-owned energy players in sectors including oil, gas, coal, electricity and nuclear power. Among those set to lose their powers are the National Energy Bureau of the Development and Reform Commission (NDRC), the State Electricity Regulatory Commission, China National Petroleum Corp. and China Petroleum & Chemical Corp. (better known as Sinopec).

The news comes despite recent rumors that President Hu Jintao’s plan to introduce a new energy law had been put on hold due to fierce political resistance to it. Stratfor had said the first step toward creating the energy megaministry would be passage of an energy law by the nation’s parliament, the National People’s Congress (NPC). It now appears that Hu is attempting to get the State Energy Commission off the ground by doing away with or postponing cumbersome legislative procedures.

For years, the NPC simply approved whatever legislation was before it; only in recent years has it started to have more say in how initiatives and policies presented to it are shaped before giving them the final go-ahead. But for an initiative as core to Beijing’s fundamental political structure as the megaministries blueprint, any real shaping already will have been finalized in back-channel discussions among Beijing’s elite — at the state council level. Thus, the energy ministry issue will relegate the NPC to its old rubber-stamping role. And if the NPC does approve the energy megaministry, it will be a significant political win for Hu.

The proposed energy law and the energy ministry are both controversial, given that each would supplant powers held for decades by key political players — especially the nation’s state planner, the NDRC. The energy law would have a great impact on foreign energy businesses operating in China, as it would introduce many new environmental requirements and legislation. The State Energy Commission, on the other hand, would have the greatest impact within the party, given that it would curtail the financial independence of China’s biggest energy players and strengthen Beijing’s grip on China’s fuel operations.

The energy ministry had been intended as the blueprint for megaministries in several sectors — including transportation, health and finance — over which Beijing wishes to exert more control. Of these, finance and energy remain the most controversial, given the enormous assets at stake and the relatively deeper involvement of foreign players within these industries. Plans for megaministries in other sectors, however, reportedly are set to win approval during the current legislative session.

Should the NPC rubber-stamp the State Energy Commission and/or a finance megaministry this session, it would signal a notable victory for Hu over some of Beijing’s most powerful political brokers. It also would accelerate the de facto nationalization of one or more of the country’s most liberalized sectors.
